OVERVIEW OF THE EB3 PROGRAM
Every fiscal year, approximately 140,000 employment-based immigrant visas are made available to qualified applicants under the provisions of U.S. immigration law. Employment based immigrant visas are divided into five preference categories. Certain spouses and children may accompany or follow-to-join employment-based immigrants.

The “other workers” or the “Unskilled Workers” subcategory is for persons performing unskilled labor requiring less than 2 years training or experience, not of a temporary or seasonal nature.

If you don't have any type of US visa or don't want to do adjustment of status you may file for Consular Process. This process will be completed while you are overseas and once the application has been approved you will get an immigrant visa stamped in your passport so you may come to United States and get your green card.

As EB-3 Unskilled is an employment based Green Card it's your obligation to start working with the employer as soon as you can and complete the one-year contract. Failure to do so may revoke your green card.

Employee Obligations

1. You agree to work for the sponsoring employer as soon as possible (target of 60 days from work authorization). You agree to work full-time for the sponsoring employer for at least 12 months.

2. 1f you do not show up to start your employment, or if you do not perform the job duties in good faith, your sponsoring employer has the right to revoke the immigration sponsorship and/or contact the U.S. government to report that you engaged in immigration fraud. This can cause your green card to be denied or revoked

3. You are willing and able to work any shifts for your sponsoring employer, including weekend, day, or night shifts. You can be fired if you refuse to work your assigned shifts.

4. You will raise any unexpected scheduling concerns or substantial difficulties (such as health issues) with BHSLGroup’ Client Services Team. We may help you make a request to the sponsoring employer in limited circumstances, but your sponsoring employer has the right to deny the request.

5. You must prioritize your work with your sponsoring employer over attending school.

6. You must prioritize your work with your sponsoring employer over working a second job.

7. You will notify BHSLGroup within 1 week of receiving your work authorization renewal and/or green card.

Employer Obligations

1. Employers must treat EB-3 unskilled workers the same way they treat U.S. workers. For example, because U.S. unskilled workers are not guaranteed shift preferences, employers have no obligation to grant EB-3 unskilled workers any scheduling requests.

2. Employers must provide a workplace free from serious recognized hazards and comply with regulations issued by the Occupational Safety and Health Administration.

3. Employers cannot discriminate against employees because of their race, color, religion, sex, national origin, age, disability, or genetic information.

4. Employers must pay EB-3 unskilled workers at least the wage listed on the Labor Certification.

5. Employers must provide workers with paystubs to document hours worked and payment amount.

6. Employers generally employ workers on a “at-will” basis, meaning employers can terminate employment at any time and for any reason, including insubordination, poor performance, and/or a refusal to work.

Under the Immigration National Act (INA), an applicant will be barred from adjusting status if the applicant continues, accepts, engages, or has previously engaged in unauthorized employment prior to filing an application for an adjustment of status. INA 254(c)(2). This bar applies to all unauthorized work during the applicant's most recent entry and all prior entries into the United States.

Unauthorized employment is ANY service or labor performed for ANY employer in the United States by a noncitizen who has not received authorization from the INA or USCIS to accept or engage in employment.

BIGGEST MYTHS ABOUT UNAUTHORIZED WORK TAXES: It doesn't matter if you did or didn't pay taxes, if you did work without authorization, then its unauthorized work and will be counted as such. Even if the IRS doesn’t report it to USCIS, it is still unauthorized work.

LAWYERS OR CONSULTANTS CAN HIDE THE INFORMATION: Attorneys, law firms, and those filing or assisting in filing of any documents before the United States government are LEGALLY OBLIGATED to report any unauthorized work on U.S. government forms. Attorneys, law firms, and others can have penalties up to, and including, prison for not reporting your unauthorized work. There is NO ATTORNEY-CLIENT PRIVILEGE in this situation

PAID IN CASH: It doesn't matter if you were paid solely in cash. Unauthorized work must and wil be reported by GLOBAL VISA & IMMIGRATION SERVICES INC Solutions and our partner law firms.

VOLUNTEERING: While you are permitted to volunteer, itis generally not allowed that you can volunteer in a position that should be filled by a paid worker.

INVESTMENTS: While foreign nationals are allowed to make financial investments to generate capital (such as in stocks or bonds) and engage in passive investments, they are NOT permitted to play an active role in the day to day running of a business or active Forex trading.
